TERMS & CONDITIONS OF STAY

at the “All-Season Wooden Cabin by the Forest” in Nowy Prażmów


§ 1. General provisions

  1. These terms and conditions (“Terms of Stay”) set out the rules for using the All-Season Wooden Cabin by the Forest located in Nowy Prażmów (hereinafter: the “Cabin”, the “Property”), including housekeeping rules, safety rules, and the Guests’ liability.
  2. The lessor / service provider is:

  3. These Terms of Stay form an integral part of the accommodation rental agreement concluded with the Guest.
  4. By commencing use of the Cabin (check-in, entering the Property, staying overnight), the Guest confirms that they have read these Terms of Stay and undertakes to comply with them, as well as to ensure compliance by all persons staying with the Guest at the Cabin.
  5. Rules regarding reservations, payments, cancellations, the complaint procedure related to the reservation process, and the rules for processing personal data during booking are set out in separate documents: the Reservation Terms and the Privacy & Cookies Policy, available in the Cabin’s booking system and on the website. These Terms do not repeat those provisions; they only supplement them with on-site stay rules.
  6. Detailed instructions for using the hot tub and the sauna constitute appendices to these Terms and are available at the Cabin. Guests are obliged to read them before using these facilities.

§ 2. Definitions

For the purposes of these Terms:

  1. Cabin / Property – the All-Season Wooden Cabin by the Forest in Nowy Prażmów together with the adjacent recreational area (terrace, fire pit area, grill, outdoor hot tub, sauna, parking spaces, etc.).
  2. Guest – a natural person with full legal capacity who has concluded the Cabin rental agreement or actually uses the Cabin; this term also includes persons staying with the Guest (family, friends).
  3. Lessor / Service Provider – the entity indicated in § 1(2).
  4. Outdoor hot tub – an outdoor, wood-fired hot tub, forming part of the Property’s equipment, made available to Guests under these Terms and the detailed operating instructions.
  5. Sauna – a sauna with a wood-burning stove, forming part of the Property’s equipment, made available to Guests under these Terms and the detailed operating instructions.
  6. Reservation Terms – a separate document governing the booking process, payments, prepayments, cancellation rules, etc.

§ 3. Nature of stay and no-party policy

  1. The Cabin is intended solely for leisure and short-term tourist/recreational stays, and not for residential purposes or for conducting business activities.
  2. A strict prohibition applies to organizing parties or events that disturb the peace, in particular:
    • bachelor / bachelorette parties,
    • loud gatherings, events, corporate/integration meetings,
    • parties with portable sound systems or a DJ.
  3. Guests are required to observe good-neighbour rules, respect nature (the nearby forest), and keep quiet in the areas surrounding the Cabin.

§ 4. Check-in / check-out times, accommodation and departure

  1. The stay period (hotel day) is, unless agreed otherwise:
    • from 4:00 PM on the day of arrival,
    • until 10:00 AM on the day of departure.
  2. Check-in is carried out according to the information provided to the Guest before arrival (access codes and the key lockbox details).
  3. At check-in, the Lessor may ask the Guest to:
    1. present an identity document (to verify booking details),
    2. confirm the number of persons who will stay at the Cabin.
  4. The number of persons staying at the Cabin must not exceed the number declared in the booking (the maximum capacity is specified in the offer).
  5. Visits by third parties (visitors) are permitted only with the Lessor’s consent and between 8:00 AM and 10:00 PM. Overnight stays by undeclared persons are prohibited and may result in immediate termination of the stay agreement and an additional charge.
  6. On the day of departure, the Guest must:
    1. leave the Cabin tidy (see § 6(7)–(8)),
    2. close windows, turn off the water, switch off electrical devices,
    3. return the keys / secure the key lockbox as instructed.

§ 5. General rules for using the Cabin

  1. Guests must use the Cabin and its equipment in accordance with their intended purpose, observing safety rules and due care.
  2. Quiet hours apply between 10:00 PM and 8:00 AM. During this time, Guests must behave in a way that does not disturb the rest of others and nearby residents.
  3. Smoking tobacco, e-cigarettes, and other substances is prohibited inside the Cabin. Smoking is permitted only outdoors in designated areas, with particular fire safety precautions. Discarding cigarette butts on the grass or elsewhere is prohibited.
  4. It is prohibited to:
    1. use additional heating devices, heaters, gas stoves, or other appliances posing a fire risk inside the Cabin that are not part of the standard equipment,
    2. bring flammable, explosive, corrosive materials or materials with a strong/unpleasant odour,
    3. interfere with the electrical, water, or heating installations,
    4. set off fireworks, firecrackers, sky lanterns, etc. on the Property and in its immediate vicinity,
    5. damage greenery, fences, or outdoor furnishings.
  5. Children under 18 may stay on the Property only under the constant supervision of adults, who bear full responsibility for them.

§ 6. Cleanliness, housekeeping and damage

  1. The Guest is obliged to maintain cleanliness and order in the Cabin and on the adjacent area throughout the stay.
  2. Any noticed defects, missing items, or damage to the Cabin’s equipment must be reported to the Lessor immediately (by phone, SMS, or e-mail).
  3. The Guest is financially liable for any damage caused in the Cabin or on the Property due to the Guest’s fault or the fault of accompanying persons or visitors, including damage caused by animals brought by the Guest.
  4. The Lessor has the right to claim compensation from the Guest for damage in the full amount of the incurred loss, under the general rules of the Polish Civil Code.
  5. In the event of serious damage or a gross breach of these Terms, the Lessor may terminate the stay agreement with immediate effect, without refund for the shortened stay, subject to mandatory provisions of law.
  6. The Guest must segregate waste in accordance with the instructions provided at the Cabin and use designated bins.
  7. Before departure, the Guest is obliged in particular to:
    1. wash dishes or place them in the dishwasher,
    2. tidy up the kitchen and living areas.
  8. If additional, non-standard cleaning is required (e.g., removal of strong odours, stains, mud, pet hair from furniture or mattresses), the Lessor may charge the Guest additional cleaning costs, requesting payment based on documented expenses.
  9. As a rule, the Lessor does not collect a cash security deposit upon arrival. Any damage is settled after the stay, based on an inspection of the Cabin and documented evidence of damage (e.g., photos, repair or replacement invoices).

§ 7. Wood-fired outdoor hot tub

  1. The outdoor hot tub is an additional amenity made available to Guests under these Terms and the detailed hot tub operating instructions available at the Cabin.
  2. The hot tub may be used only by adults and by minors under the direct supervision of an adult who assumes full responsibility for their safety.
  3. In particular, the hot tub should not be used by persons:
    1. with cardiovascular or respiratory conditions, or high blood pressure,
    2. with epilepsy, acute rheumatic conditions, cancer, acute infections, or fever,
    3. who are pregnant or menstruating,
    4. under the influence of alcohol or other intoxicants,
    5. extremely fatigued or with other health contraindications.

    The decision to use the hot tub is made by the Guest at their own risk; in case of doubt, medical consultation is recommended.

  4. Lighting the hot tub stove is strictly prohibited until the tub is filled with water to the indicated level (approx. 4/5 of its height). The detailed filling and lighting procedure is set out in the instructions.
  5. Guests are obliged to:
    1. use the hot tub in appropriate swimwear (without elements that could damage the surface),
    2. exercise particular caution when entering and exiting (wet surfaces may be slippery),
    3. observe the maximum number of persons in the hot tub as per the instructions (typically max. 6 persons).
  6. In particular, it is prohibited to:
    1. jump into the hot tub, dive, or push other people into the water,
    2. bring food, glass beverages/containers, or sharp objects into the hot tub,
    3. pour any substances into the water (oils, liquids, salts, cosmetics),
    4. change settings or tamper with the stove or technical components not covered by the instructions,
    5. leave children unsupervised near the hot stove, steps, or the hot tub itself.
  7. After using the hot tub, Guests must:
    1. extinguish the fire in accordance with the instructions,
    2. cover the hot tub with the lid,
    3. tidy up the area around the hot tub.
  8. During low temperatures, technical faults, utility outages, or other circumstances beyond the Lessor’s control, the hot tub may be temporarily unavailable for safety reasons. In such case, Guests are not entitled to compensation unless otherwise provided by the agreement or mandatory law.

§ 8. Sauna

  1. The sauna is provided to Guests as an additional amenity under these Terms and the detailed sauna instructions available at the Cabin.
  2. The sauna may be used only by adults and by minors solely under the continuous supervision of an adult guardian who assumes full responsibility for their safety.
  3. In particular, the sauna should not be used by persons:
    1. with heart conditions, high blood pressure, or vascular diseases,
    2. with thyroid disease, epilepsy, or claustrophobia,
    3. with acute rheumatic conditions, cancer, acute infections, or asthma attacks,
    4. with fever or feeling unwell,
    5. who are pregnant or menstruating,
    6. under the influence of alcohol or other intoxicants.

    If in doubt about your health condition, medical consultation is recommended before using the sauna.

  4. Before entering the sauna, the Guest must:
    1. attend to physiological needs,
    2. remove jewellery, watch, glasses, and contact lenses,
    3. shower and dry the body thoroughly,
    4. enter the sauna with a towel or in swimwear, observing hygiene rules.
  5. In the sauna:
    1. sit only on a towel so that no part of the body touches the bench directly,
    2. each session should be moderate (typically 8–15 minutes), with breaks for cooling down and hydration,
    3. the Guest chooses the temperature and duration at their own discretion, using common sense and observing safety.
  6. It is prohibited to:
    1. enter the sauna under the influence of alcohol or other intoxicants,
    2. bring food or drinks (especially in glass containers),
    3. pour substances other than clean water onto the stove (in particular oils, beverages, milk).
  7. After using the sauna, Guests must leave the room tidy (dispose of trash and arrange towels).

§ 9. Grill, fire pit and terrace

  1. A designated area for a fire pit and use of the grill is available on the Property.
  2. It is prohibited to:
    1. light a fire on the grass, in the forest, or in places not designated for this purpose,
    2. leave fire unattended,
    3. use flammable liquids (petrol, solvents, etc.) to start a fire.
  3. After finishing with the fire pit, the Guest must fully extinguish the fire and ensure there is no risk of re-ignition.
  4. The terrace (including outdoor furniture) must be used with due care.

§ 10. Pets

  1. Pets are allowed only upon prior arrangement with the Lessor and after payment of the applicable pet fee.
  2. The pet owner is obliged to:
    1. keep the pet under constant control,
    2. prevent disturbance to others (barking, noise, aggression),
    3. clean up after the pet on the Property,
    4. prevent damage to the Cabin’s equipment and greenery.
  3. Pets should not be on beds, mattresses, or upholstered furniture. In the event of soiling/damage, the Lessor may charge an additional fee for cleaning or repair.
  4. The Guest bears full responsibility for any damage caused by pets on the Property.

§ 11. Safety, emergencies and liability

  1. In the event of:
    • fire,
    • danger to health or life,
    • observing a serious installation failure
    the Guest must immediately notify the relevant emergency services (emergency numbers 112 / 999 / 998) and the Lessor.
  2. The Lessor is not liable for:
    1. valuables left by Guests in the Cabin or on the Property,
    2. damage resulting from improper use of the Cabin, hot tub, sauna, grill, fire pit, and other infrastructure,
    3. temporary interruptions in utilities (electricity, water, internet) caused by circumstances beyond the Lessor’s control (e.g., network failures, storms, operator works).
  3. The Guest uses the Cabin and the adjacent area at their own risk.

§ 12. Complaints regarding the stay

  1. Any comments or objections regarding the Cabin’s standard, cleanliness, equipment, or other stay-related matters should be reported immediately—preferably on the day they are noticed—by phone, SMS, or e-mail to the Lessor, to allow a response and possible remedy.
  2. Complaints regarding the stay itself (and not the online booking process) may also be submitted after the stay in writing or by e-mail within 14 days from the date of departure.
  3. The rules for complaints regarding bookings made via the booking system are set out in the separate Reservation Terms.

§ 13. Personal data

  1. The controller of Guests’ personal data is Justyna Czernik, contact details as in § 1(2).
  2. Detailed rules for personal data processing, including purposes, legal bases, retention periods, and data subjects’ rights, are set out in the separate Privacy & Cookies Policy available in the booking system and on the website. These Terms do not repeat those provisions.

§ 14. Final provisions

  1. In matters not regulated herein, the relevant provisions of Polish law shall apply, in particular the Polish Civil Code.
  2. Any disputes arising in connection with Guests’ stay at the Cabin shall, in the first instance, be resolved amicably. Failing agreement, the competent common courts shall be determined in accordance with general rules.
  3. These Terms may be updated from time to time; the new version shall apply to bookings and stays made after its effective date.
  4. The current version of these Terms is available in the booking system and at the Cabin (in printed or electronic form).
